
(ReclaimingAmerica.com) – HAPPENING NOW: A state appeals court in New York has dismissed a $250 million lawsuit brought by New York Attorney General Letitia James against Ivanka Trump. The lawsuit accused Ivanka Trump of business fraud during her tenure at the Trump Organization.
The appellate court, comprised of five judges, decided the allegations made by James against Ivanka Trump did not fit within the time frame dictated by the state’s statute of limitations. This law limits the time in which legal proceedings can be initiated.
The judges also pointed out that some of the more recent claims of improper actions happened after Ivanka had already withdrawn from her family’s business to assist her father at the White House.
The court’s ruling stated: “The allegations against defendant Ivanka Trump do not support any claims that accrued after February 6, 2016. Thus, all claims against her should have been dismissed as untimely.”
Furthermore, the court ruled that James cannot bring forth legal proceedings over any allegations that arose before July 13, 2014, or February 6, 2016, depending on who the defendant is.
In September 2022, James filed a lawsuit against the Trump Organization, former President Donald Trump, and his three eldest children – Ivanka, Donald Jr., and Eric. She alleged that they deceived banks, insurance companies, and others by misrepresenting the value of the former president’s assets, including golf courses and Mar-a-Lago.
James’ lawsuit seeks $250 million in damages from the Trump family and proposes a prohibition on them conducting business in New York.
The lawsuit will continue against the other defendants. However, the court indicated that the scope of the case might be reduced in the future.
A Trump representative responded to the ruling, telling Fox News Digital: “The Appellate Division decision today represents the first step towards ending a case that should have never been filed. The correct application of the law will now limit appropriately the previously unlimited reach of the Attorney General.”
A spokesperson from James’ office said there’s still “a mountain of evidence that shows Mr. Trump and the Trump Organization falsely and fraudulently valued multiple assets and misrepresented those values to financial institutions for significant economic gain.”
The spokesperson added, “Those facts haven’t changed. This decision allows us to hold him accountable for that fraud, and we intend to do so.”
The former president has consistently rejected these allegations, contending that the lawsuit is politically driven since James is a Democrat. He has also labeled her as a “racist.”
The lawsuit is slated to go to trial on October 2.
