Defense Secretary Pete Hegseth explained that Kelly faces investigation because he formally retired from the military and remains under Pentagon jurisdiction.
The other lawmakers in the video—Senator Elissa Slotkin and Representatives Jason Crow, Chris Deluzio, Maggie Goodlander, and Chrissy Houlahan—are not subject to military law.
